Mississippi state law requires anyone who intends to operate a food establishment in the state to obtain a permit from the Mississippi State Department of Health (MS Code of 1972 §41-3-15).
Manufacturing facilities, processors, warehouses, re-packers, food vending companies, ice plants, and seafood processors are regulated by the Mississippi State Department of Health's Division of Food Protection.
The MSDH Division of Food Protection regulations have been adopted from the Federal Food, Drug and Cosmetic Act as well as several portions of the Code of Federal Regulations, Title 21.
Prior to Licensing
Before opening a food business in Mississippi, there are several steps that need to be taken prior to the business becoming operational.
- If you will be using a private water source, contact the MSDH Bureau of Water Supply: 601-576-7518.
- If you have an on-site wastewater system, contact the MSDH Division of On-site Wastewater to ensure that your system can accommodate the output from your operations: 601-576-7150.
- Submit a Plan Review early to ensure your operation meets the basic regulatory requirements.
- Ensure that label(s) on all food product(s) are accurate and meet the regulatory requirements. Refer to the FDA's Food Labeling Guide for additional guidance on labeling your product. A final, finished product label is required prior to a food facility becoming licensed and operational.
